Fishtree User Privacy Policy

Fishtree takes your privacy (individually, “Your” or collectively, “Users”) very seriously.

This Privacy Policy describes what information we gather from you, how we use that information, and what we do to protect it. By using the site and the Fishtree platform, you expressly consent to the information handling practices described in this notice.

This Privacy Policy is incorporated into and is subject to the Fishtree Terms of Use. Your use of the Website, the Platform and any personal information you provide on the Website are subject to the terms of this Privacy Policy and Fishtree Terms of Use.

Section 1.1: Personally Identifiable Information

Fishtree collects information in several ways.

Some personal information is gathered when you register for use of Fishtree. Depending on your account type (or “Plan”), Fishtree may ask for your name, e-mail address, and/or additional information. We may also ask you to choose a username and password.

In addition to the information we collect when you register, we may ask you for personal information at other times, such as when you contact our technical support team. Furthermore, when you send e-mail, user surveys, or other communication to Fishtree, we may retain those communications in order to process your inquiries, respond to your requests, and improve our services.

If you choose to provide such information, during registration or otherwise, you are giving Fishtree the permission to use and store it consistent with this policy.

Section 1.2: Cookies

As part of offering and providing customizable and personalized services, Fishtree uses cookies to temporarily store information about you. A cookie is a small file on your own computer containing a string of characters that uniquely identifies your browser. We use cookies to better display our website, to save you time, and to provide better technical support.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services (particularly those that require you to log in) may not function properly if your cookies are disabled.

Section 1.3: “Automatically Collected” Information

When you use the Website, we may automatically record certain information from your browser. This “automatically collected” information may include your Internet Protocol (IP) address, browser type, internet service provider (ISP), referring or exit pages, click stream data, operating system and the dates and times that you visit the site. Additionally, we may record certain information regarding your use of content viewed through the Fishtree Platform such as the number of times you have interacted with a piece of content or the amount of time spent with certain content.

Section 2.1: Use of Information

Fishtree’s goals in collecting personal information are to provide you, the user, with a much better experience with our technology and a high level of support. Fishtree does research on our users’ demographics, interests, and behavior based on the information provided to us upon registration, from our server logs, or from surveys. We do this to better understand and serve our users; for instance, this information often gives us ideas for improving our products. This research is compiled and analyzed on an aggregated basis.

Section 3.1: Disclosure of information.

As a general rule, Fishtree will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. The following describes some of the reasons that your information may be disclosed: Business Partners & Sponsors. Fishtree will never disclose your personal information to business partners or sponsors, unless it is specifically described to you prior to data collection or prior to transferring the data. If personally identifying data about you will be shared, we will tell you before we collect or transfer the data. If Fishtree becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will provide notice before personal information is transferred and becomes subject to a different privacy policy. Third Party Data & Data in the Aggregate. Under confidentiality agreements, Fishtree may match user information with third party data. Also, Fishtree discloses aggregated user statistics in order to describe our services to current and prospective partners and other third parties, and for other lawful purposes.

Shared Information. Fishtree enables you to share your User Postings with other Users of the site. If your User Postings are shared with other Users, any personally identifiable information that you choose to include in, or is associated with, such User Postings will be accessible by such Users. Once you make your personally identifiable information available to others in any of these ways, it may be collected and used by the recipients without restriction.

Fishtree enables Users to share information and resources. If you are a User subscribing to the Website and you consent, Fishtree may disclose certain personally identifiable information to other Users of the Website, such as your teachers or other Users. If you consent, Fishtree may also share information about your use of certain site features with other Users of the site, such as sharing your activity history with your teacher or Users associated with your Educational Organization.

Other. Fishtree may release personal information if it has a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request; (b) enforce applicable Terms of Service, including investigation of potential violations thereof; (c) detect, prevent or otherwise address fraud, security or technical issues; or (d) protect against imminent harm to the rights, property, or safety of Fishtree, its users, or the public as required or permitted by law.

Section 4.1: Your choices regarding collection, use and distribution of information

Fishtree may, from time to time, send you e-mail regarding our products and services. Only Fishtree will send you these direct mailings. You can choose not to receive these e-mails by clicking the unsubscribe link in any e-mail or contacting You also have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. However, if you choose to reject all cookies you will be unable to use those Fishtree services, such as the activity and quiz creation tools, which require registration in order to participate. You may decline to share your personally-identifiable information with Fishtree, in which case Fishtree will not be able to provide to you some of the features and functionality found on the Fishtree Platform. To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Section 5.1: Third party advertisers and links to other sites

The site may be linked to internet websites operated by other companies. Fishtree may also permit other companies, called third-party ad servers or ad networks, to serve advertisements within the site. These third-party ad servers or ad networks may use technology to send, directly to your browser, some of the advertisements and links that appear on the site. These advertisers may automatically receive your IP address if this happens.

You should consult the respective privacy policies of these third-party websites and third party ad servers or ad networks. Fishtree’s privacy policy does not apply to, and we cannot control the activities of, such other third party advertisers or web sites. Please be aware that Fishtree does not warn you when you have chosen to link through to another website from the Website.

Section 6.1: Updating, correcting or deleting your personally identifiable information

You may edit your account information at any time by logging into your account and clicking the Account or Profile link. We recommend that you review your personal information periodically to ensure that it is accurate, complete, and current. If you have forgotten your password, go to the password request form. A new password will be sent to the e-mail address you specified during registration. For all other problems logging into Fishtree services, please contact technical support for that service. Please contact technical support for further instructions about deleting or deactivating your account for any Fishtree service. Residual information will remain within our archive records.

Section 7.1: Security precautions

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These include internal reviews of our data collection, storage, and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. Your registered accounts are password-protected so that you and only you have access to any personal information you have entered in your account. You may edit your account information at any time by logging into your account and clicking the Account or Profile link.

For your protection, remember to log out of all accounts before closing your browser. There is a log out link available on most Fishtree pages. After logging out, make sure to close all browser windows. This is to ensure that others cannot access your personal information if you share a computer with someone else or are using a public computer. We restrict access to personal information to Fishtree employees, contractors, and agents who need to know that information in order to operate, develop, or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Section 8.1: Children’s privacy

Fishtree does not ask a child under age 13 for more personal information, as a condition of participation, than is reasonably necessary to participate in a given activity. Fishtree does not gather information on the ages of our users and will never knowingly share personally identifying information about users who are under the age of 13 with business partners or other third parties.
